- The terms establish user ownership of protectable Output but do not provide a single universal commercial-license clause covering every generated feature and bundled asset. Commercial use therefore remains subject to third-party media licenses and applicable rights.
- The privacy policy's general language allows AI training and service improvement, while newer Help Center guidance says in-house training is opt-in and production models use no user data. The exact default for a particular non-Enterprise account should be confirmed in its current Share Data setting.
- AI-generated output may not qualify for copyright protection and may resemble output generated for other users.
Terms last updated February 25, 2025 say Descript claims no ownership of User Content. Inputs and AI-generated Outputs are User Content, and as between the user and Descript, the user owns them to the extent protectable under applicable law. Descript warns that outputs may not be unique or copyrightable and makes the user responsible for third-party rights and legal suitability. Descript may use Inputs and Outputs for model and service development unless the user opts out; its agreements prohibit third-party AI providers from using those Inputs and Outputs to train their own models. Current Help Center guidance is more specific: production models use no Descript user data, internal R&D uses only data from users who opted into sharing, and Enterprise sharing is disabled by default. Descript requires explicit recorded authorization from the depicted speaker before creating a custom voice clone; it refuses deceased, non-consenting, non-authorizing, or artificial-source voices.
