Open verification questions
  • GitHub does not publish a numeric AI-credit allowance for Copilot Free or Student on the plans page.
  • The public Terms do not give a blanket commercial-use warranty, non-infringement guarantee, or ownership assignment for generated Output; they only state that GitHub does not claim ownership.
  • Starting April 22, 2026, new self-serve Copilot Business sign-ups for organizations on GitHub Free and GitHub Team were temporarily paused; the official page did not publish an end date.

GitHub's Terms effective April 27, 2026 state that GitHub does not claim ownership of Copilot Input or Output. For individual licenses, GitHub and its affiliates may use Inputs and Outputs to develop, train, and improve AI/ML models unless the user opts out in account settings. The individual-license training provision does not apply when use is governed by a GitHub Customer Agreement or volume licensing agreement; those agreements control data use. GitHub says Inputs and Outputs are not shared with third-party AI model providers for those providers' independent model training. GitHub warns that Output can resemble training data or third-party/open-source code. Users must determine whether a license is required and review, test, and validate Output. GitHub's broader Terms grant GitHub and its affiliates rights to use hosted user content to develop and train AI technologies; the Copilot opt-out does not apply to public-repository content or the broader repository-content license.

Replit AI

Starter is free with daily Agent credits, free daily usage, one published live project, and a built-in database. Replit also uses effort-based/pay-as-you-go and usage-based billing for applicable AI, deployment, and database resources.

Open verification questions
  • The explicit Output Content ownership and no-training language is in the Commercial Agreement. The general consumer Terms do not publish an equally explicit assignment of rights in AI-generated Output.
  • The pricing page labels free and included Agent allowances qualitatively rather than publishing exact numeric Agent-credit limits.
  • Third-party AI services are excluded from the Commercial Agreement's definition of Replit AI Features and can be governed by separate provider terms.

Official documentation describes Replit Agent as turning plain-language requests into apps, designs, slides, and other artifacts. The Commercial Agreement states that commercial customers retain all rights in Input Content and own Output Content. Under the Commercial Agreement, Replit will not use Customer Content to develop or improve products, train machine-learning models, or create derivative works except as expressly permitted; customer-requested tuning may be performed solely for that customer's use during the agreement term. The consumer Terms state that users retain their rights in content they submit and grant Replit the operational rights needed to provide the service. Replit's Privacy Policy was last updated August 3, 2026 and covers collection of usage, interaction, project, command, payment, and communication data, along with applicable access, deletion, correction, appeal, and sale/sharing opt-out rights.
